Legal and Copyright Information

All the boring stuff...

Terms and Conditions

Welcome to my website. Please be advised that if you continue to browse and use this website you are agreeing to comply with and be bound by the following terms and conditions of use.

If you have any questions, please do not hesitate to contact me.

Privacy Policy

Client privacy and confidentiality is important to me.  The personal information disclosed to me by clients,  including their full name, email address, delivery address, telephone number and other personal information, is never disclosed to any third parties.

Commission Progress

When a commission agreement has been reached between both parties, I send a unique, password protected website link to the client.  This will enable them to have access to their account in which they will be able to make the deposit payment.  They will then receive updates regarding the work that is being undertaken on their behalf.  This may include written and/or photographic updates.  Some clients ask not to see the image until it is finished.  This will be taken into account and only written updates will be added.

Copyright

I retain copyright on all the artwork that I produce.

This website and its content is copyright of Paul Wakeford - © Paul Wakeford 2018. All rights reserved.

Any reproduction or redistribution of part or all of the contents is prohibited except with our written permission.

When commissioned artwork has been completed, it is displayed in my website gallery. Clients who do not wish their commissioned artwork to be shown in my gallery must notify me when ordering.

At the time of ordering, clients may be given the option of agreeing to allowing me to sell prints of the finished artwork as pictures and/or other merchandise.   The client’s agreement to this option is reflected as a reduction in the cost of the finished work.  This can be anything up to 50%.

If this option is not offered to a client, I will use images of the commissioned artwork as promotional material, never to reproduce to make profit.

If the reference photographs provided by clients are taken by a third party and the copyright does not belong to the client, the client must obtain permission to use the photographs and must provide proof of this to me when ordering their artwork.

Deposits

I will produce an invoice before I begin a client’s commission.  This will reflect any agreed reduction as mentioned above and will indicate the amount of the deposit required which is usually 50% of the total cost of the artwork.  The payment can be made via the client’s Commission Progress link.

Payment of the deposit indicates the clients have read and understood the terms and conditions in full.

The invoice must be paid in full before I will release the finished work.

Completion Time

The time it takes to complete a commission depends on the time of year, the length of my waiting list and the size and type of work required. An estimated time of completion will be given to a client when ordering and updates can be seen on the client’s Commission Progress link. Clients must let me know if the artwork needs to be completed before a specific date, and I will do my very best to ensure it is completed and released in time.

Please order early to avoid disappointment.  This is especially important around Christmas time.

Cancellations

My clients are given a 7-day money back guarantee from the date of their order and they will receive a full refund.

If clients wish to cancel their order after 7 days but before I have started the artwork, they will receive a refund of their deposit minus any fees.

If clients wish to cancel their order after 7 days and I have already started the artwork, their deposit will not be refunded.

Wherever possible, I like the clients to see the artwork in person before they make the final payment.  This allows them to ask about changes that they require to ensure that they are fully satisfied.

If this is not possible,  the artwork will be sent Royal Mail Special Delivery Next Day Service.  Clients then have 7 days to contact me about any changes required.

If clients receive their painting, do not allow me to make adjustments and want a refund, they will be given a refund minus the deposit amount and fees.  The refund will only be released when the artwork has been returned to me.  Clients must pay the cost of returning their artwork whether they require adjustments or want a refund.

Payment

All commissions must be secured with a deposit before I commence work. Full payment is required before artwork is released.  Clients can pay via Paypal, Bank Transfer or cheque.

Delivery

Wherever possible, I like the client to receive their commissioned artwork in person.  When this is not possible, delivery costs will vary depending on the size of the artwork and destination. Unless otherwise agreed, artwork will be sent by Royal Mail Special Delivery Next Day Service.

Damage in Transit

All of my artwork is fully insured during delivery. In the unlikely event that work is damaged in transit, I must be contacted immediately.  Clients must keep all packaging and contents and make a note of damages on the delivery record to receive compensation.

Damaged paintings must be returned to me at the cost of the client and I will complete another painting completely free of charge.
